Requirements

  • Juris Doctor degree from an accredited law school
  • Experience as a commercial attorney providing legal advice to medical device or healthcare businesses
  • Expertise in drafting, negotiating, and reviewing complex commercial agreements (e.g., procurement, sales, licensing, marketing, co-promotion, research collaborations)
  • Knowledge of laws affecting sales and marketing to healthcare professionals, including fraud and abuse (Anti-Kickback Statute, False Claims Act), FDA regulation (Food, Drug & Cosmetic Act), privacy (HIPAA), and anti-corruption (Foreign Corrupt Practices Act)
  • Good judgment: Expertise and sound judgment to provide practical, risk-balanced advice
  • Collaboration: Ability to integrate information from multiple sources in a complex, global, matrixed environment
  • Anticipation: Holistic thinking to anticipate changes in law, enforcement, or business objectives
  • Influencing skills: Build relationships, negotiate, and represent externally

Responsibilities

  • Draft, negotiate, and review a wide range of commercial agreements, including procurement, sales, licensing, marketing, co-promotion, and research collaborations
  • Review marketing programs and promotional materials for compliance with FTC truth-in-advertising, Abbott policies, and applicable law
  • Provide sound, practical, and timely legal advice on matters related to commercial business operations marketing to healthcare professionals
  • Resolve legal issues using negotiation skills and legal expertise, including pre-litigation dispute resolution and settlements
  • Assist in creating template agreements, playbooks, and training for efficient contracting processes
  • Develop knowledge of Abbott’s businesses, products, and supported client areas
  • Maintain familiarity with relevant laws to issue spot and provide basic counseling
  • Represent Abbott externally to suppliers and customers
  • Help select and/or direct outside counsel, define project objectives, manage projects, and monitor budgets
  • Interact with Legal, Compliance, Finance, Education, Supply Chain, R&D, Regulatory, Quality, Clinical, Marketing, Commercial/Sales, and IT departments
  • Travel infrequently (10-15%)
