Requirements

  • Experienced commercial attorney with expertise in providing legal advice to a medical device division
  • Ability to identify and resolve complex legal issues supporting research, development, manufacturing, sales, and marketing of medical device products
  • Strong drafting, negotiating, and reviewing skills for a wide range of commercial agreements (e.g., business development, supply chain, sales, licensing, marketing, co-promotion, research collaborations)
  • Knowledge of laws affecting sales and marketing to healthcare professionals, including fraud and abuse (Anti-Kickback Statute, False Claims Act), FDA regulation (Food, Drug & Cosmetic Act), privacy (HIPAA), anti-corruption (Foreign Corrupt Practices Act), FTC truth-in-advertising, and government reimbursement
  • Negotiation skills for resolving legal issues, including pre-litigation dispute resolution and settlements
  • Good judgment: Demonstrate expertise, sound judgment, understanding of how responsibilities support business objectives, and ability to provide practical, risk-based advice
  • Ability to develop knowledge of Abbott’s businesses, products, and client areas
  • Experience representing externally to suppliers and customers
  • Capability to help select/direct outside counsel, define project objectives, manage projects, and monitor budgets
  • Willingness to travel infrequently (10-15%)

Responsibilities

  • Drafting, negotiating, and reviewing agreements including business development, supply chain, sales, licensing, marketing, co-promotion, and research collaborations
  • Reviewing marketing programs and promotional materials for compliance with FTC truth-in-advertising, Abbott policies, and applicable law
  • Providing sound, practical, and timely legal advice on matters related to commercial business operations marketing to healthcare professionals
  • Resolving legal issues using negotiation skills and legal expertise, including pre-litigation dispute resolution and settlements
  • Assisting in creating new template agreements, playbooks, and training to support efficient contracting processes
  • Developing knowledge of Abbott’s businesses, products, and supported client areas
  • Maintaining familiarity with relevant laws to issue spot and provide basic counseling
  • Representing Abbott externally to suppliers and customers
  • Helping select and/or directing outside counsel, defining project objectives, managing projects, and monitoring budgets
  • Interacting with Legal, Compliance, Finance, Education, Supply Chain, R&D, Regulatory, Quality, Clinical, Marketing, Commercial/Sales, and IT Departments
