Requirements

  • Juris Doctor from a nationally recognized US law school and admission to practice law
  • 5+ years of experience working with commercial contracts as an in-house corporate attorney, or with a law firm, with significant exposure to federal government contracts

Responsibilities

  • Provide legal support within the US Commercial Legal team on topics including medical device and technology sales and marketing programs, commercial sales agreements, and other commercial contracts, including federal government contracts
  • Provide guidance, structure, draft, and negotiate agreements with respect to various strategic opportunities, such as new and innovative sales programs, discount arrangements, group purchasing organization agreements, technology agreements, distribution, capital sales programs, or service and repair agreements
  • Provide guidance on Federal Acquisition Regulations (FAR) and Defense Federal Acquisition Regulation Supplement (DFAR) in relation to sales to the US government
  • Advise on administrative policies impacting state and federal government contracting and commercial matters
  • Identify, assess, and communicate key contract risks, obligations, and practical mitigation strategies to internal stakeholders
  • Collaborate closely with Medtronic’s various legal Centers of Expertise (COEs) and other legal and compliance professionals, as needed, to deliver the highest quality practical and strategic advice to sales, finance, and other stakeholders to close deals effectively and compliantly
  • Advise on federal healthcare laws, antikickback, antitrust, False Claims Act, HIPAA, state data privacy and security laws, software licensing, FDA law, IP and other legal risk areas governing healthcare technology commercial transactions
  • Develop, review, or implement company-wide and/or functionally specific training programs for the areas described above
