Candidates should have a JD from a top-level law program, with a preference for US-trained lawyers, though international JDs will be considered. A minimum of 3-6 years of legal experience focused on payments, fintech, or financial services regulation is required, along with a strong understanding of domestic and international payments regulations such as MTLs, Durbin, EMI/e-money, card scheme rules, and PSD2. Experience advising on commercial contracts and regulatory issues for fintech or payments companies is essential, as are excellent written and verbal communication skills and a collaborative, business-oriented mindset. Digital assets/crypto regulatory experience is a strong plus, and prior in-house experience at a fintech, payments company, or financial regulator is a bonus. Privacy experience is also a plus.
The Payments Counsel will advise on U.S. and international payments regulations, including money transmission, stored value, card networks, e-money, and virtual asset frameworks. Responsibilities include partnering with Compliance and Licensing teams on MTL applications and international licenses, drafting cardholder agreements, and drafting, reviewing, and negotiating commercial agreements with banks, payment processors, card networks, and vendors. The role also involves providing practical guidance on consumer protection requirements, managing relationships with outside counsel, assisting with responses to regulators, and participating in audits, exams, and inquiries. Staying ahead of regulatory changes affecting payments, crypto, and fintech, and helping to shape internal strategy and external engagement are also key duties.
