Requirements

  • MSc in Civil, Mechanical or Electrical Engineering, or Quantity Surveyor
  • At least 10 years of experience in large Construction projects, managing complex Contracts in an international environment, of which at least 4 years in a similar position
  • Experience in EPC and design-build contracts is a plus
  • FIDIC contracts management is a plus
  • Additional law and/or specific construction contracts degree is valued
  • Computer literate (MS Office)
  • Excellent command of English; French and Arabic preferred; Spanish is a plus
  • Strong organizational, analytical and problem-solving skills
  • Excellent communication skills, customer orientation and proven ability to work within complex organizations across functional areas as well as externally with customers and consultants

Responsibilities

  • Analyse the Main Contract and Schedules, with particular regard for contract procedures requiring formal notices, time limits and other parameters to ensure full understanding of obligations and rights
  • Ensure the Project Team is fully aware of prevalent constraints, conditions and contractual environment; develop appropriate documentation such as a Contract Manual and/or sketches to illustrate critical contractual mechanisms
  • Ensure proper mechanisms for risk transfer to subcontractors and insurance providers are identified and enforced
  • Protect the contractual position at all times, enforcing the notification regime of the Contract
  • Prepare submissions for Variations including adjustments to scope and Extensions of Time, with proper substantiation on entitlement, quantum, cause and effect, and program impact analysis; agree with Project Director prior to submission to Client and negotiate if needed
  • Prepare submissions for Claims based on obstructions, disruptions, delays and other contractually allowable events; agree with Project Director prior to submission to Client and negotiate if needed
  • Fully monitor and report exposure to Liquidated Damages
  • Prepare and coordinate with the legal department determinations on interpretations under the Contract; preliminary action on dispute management; procedural compliance for potential contractual and legal consequences; and potential termination
  • Support the Project Manager/Project Director in management of the Main Construction Contract within constraints of time, cost, quality and safety by monitoring and reporting compliance of contractual obligations
  • Manage Main Contract and Sub-contracts, implement efficient internal and external communications protocols, site liaison, negotiation of change orders and variations, sub-contractor management, and active contractual risk management, monitoring and reporting
  • Provide contractual support to the procurement team
