Requirements

Candidates should possess a J.D. degree from an accredited school and be actively licensed to practice law in the United States, with a minimum of 7 years of legal experience focusing on healthcare law. Extensive knowledge of the Health Insurance Portability and Accountability Act (HIPAA) and its regulations, including a consistent record of providing legal support to pharmacies, Covered Entities, and Business Associates, is required. Familiarity with digital health privacy, pharmacy operations, and related healthcare data protection laws is also necessary.

Responsibilities

The Senior Director will serve as the primary legal advisor on HIPAA Privacy and Security Rules, HITECH, and related healthcare data protection laws, providing counsel on the design and implementation of digital health technologies and pharmacy management systems. They will advise on legal risks and mitigation strategies related to pharmacy intake and dispensing operations, draft and review contracts involving protected health information, collaborate with IT and Compliance teams, monitor evolving privacy laws, support incident response, and provide training on HIPAA and digital privacy. Additionally, they will oversee legal responses to data breaches, support audits, and contribute to negotiations regarding privacy provisions in agreements, as well as support audits, regulatory inquiries, and enforcement actions.
